2. Subject

2.1.

Kude.bg is an online platform that provides users with information about businesses, places, services and other offers published on or available through the platform.

2.2.

The platform provides features related to:

• searching for and discovering businesses;
• viewing information about businesses and services;
• user profiles;
• saving businesses and content;
• publishing and managing information;
• ratings, reviews, photos and other user content;
• bookings and communication between users and businesses;
• management of a business by its owner and staff;
• other features that may be added or changed over time.

2.3.

The Company reserves the right to change, add or remove individual features of the platform, and doing so is not a breach of these Terms.

2.4.

These Terms apply equally to the kude.bg website, to the “Kude.bg” app (for users) and to the “Kude.bg Бизнес” app (for business owners and staff). The website and the apps share one account. The apps are downloaded from the App Store and Google Play; those stores’ terms apply in addition, and the Company — not Apple or Google — is responsible for the apps and their content.

3. Registration and user account

3.1.

Some features require an account.

3.2.

When registering, the User undertakes to provide true, accurate and up-to-date information.

3.3.

The User is responsible for keeping access to their account secure — including the e-mail inbox that receives sign-in codes and the devices they are signed in on — and should take the necessary measures to prevent unauthorised access.

3.4.

If the User suspects unauthorised access to their account, they should notify the Company immediately at contact@kude.bg or support@kude.bg.

3.5.

The Company may restrict or terminate access to an account in the event of a breach of these Terms, of applicable law, or of established abuse of the platform (section 13).

3.6. Minimum age

You must be at least 16 years old to create an account. By creating an account the User declares that they meet this requirement. If the Company learns that an account was created by a younger person, it deletes the account. Viewing public information on the platform does not require an account.

3.7. Deleting your account

The User may delete their account at any time — in the apps, on the website, or by request by e-mail. What is deleted and what remains (for example published reviews, without the author’s name) is described on the Delete your account page and in the Privacy Policy.

4. Rules of use

The User undertakes:

1. to use the platform in good faith;
2. not to use the platform for unlawful purposes;
3. not to provide false or misleading information;
4. not to infringe the rights of other users or third parties;
5. not to publish content that breaks the law or public morals;
6. not to take actions that may disrupt the normal operation of the platform;
7. not to use automated means to extract, copy or systematically collect information from the platform unless expressly permitted by the Company.

5. User content

5.1.

Users may publish content, including ratings, reviews, photos, replies to reviews, a public profile bio and messages to businesses or to customers.

5.2.

The User is fully responsible for the content they publish or send.

5.3.

The User declares that they hold the necessary rights to the content they publish (including photos) and that publishing it does not infringe the rights of third parties.

5.4.

It is not permitted to publish or send content that:

• is unlawful;
• contains insults, threats, harassment or discriminatory content, including on grounds of race, ethnicity, religion, sex, sexual orientation, disability or age;
• infringes intellectual property rights;
• contains other people’s personal data without a legal basis (for example another person’s phone number, address or photo);
• is deliberately false or misleading, including fake reviews, paid reviews, or reviews of one’s own or a competing business;
• is spam or advertising published without permission;
• contains malicious code or material intended to compromise the security of the platform;
• is pornographic, sexually explicit or inappropriately directed at children;
• depicts or incites violence, self-harm, terrorism or drug use;
• is unrelated to the business or to the specific visit it is published about.

5.5.

The Company may remove or restrict access to content that breaches these Terms or applicable law.

5.6. Zero tolerance

There is no place on Kude.bg for objectionable content under clause 5.4, or for users who harass, threaten or insult other users or business staff. Such content is removed, and the accounts that publish it are restricted or closed under section 13 — including on a first offence if it is serious.

5.7. Rules for reviews

• A review must describe the author’s own experience of the business.
• Reviews of a business the author owns, manages or works at, or of a direct competitor, are not allowed.
• Reviews in exchange for payment, a discount or any other benefit, and threats of a negative review, are not allowed.
• Criticism is welcome if it is substantive and contains no insults or personal data of staff.
• The review and rating are shown publicly, together with the author’s name and public profile.

5.8. Rules for photos

Photos attached to a review must be taken by the author and show the business, its products or services. Photos in which other people can be recognised without their consent, photos of documents and content under clause 5.4 are not allowed.

5.9. Reviews are checked before publication

By default, new reviews and their photos are published after a check by the Kude.bg team. The Company may also publish reviews without a prior check and review them when they are reported. A check does not mean the Company confirms that a review is true — responsibility for the content stays with its author (clause 5.2).

5.10. Messages between customers and businesses

• Messages on Kude.bg are for questions, bookings and service relating to that business.
• A business may not use messages or a customer’s contact details for advertising unless the customer has expressly consented; it may not demand payments outside the platform under pressure, nor ask for card details.
• Neither the customer nor the business may send content under clause 5.4, including insults, threats and persistent unwanted messages.
• Either side may block the conversation (clause 5.12) and report it (clause 5.11).

5.11. Reports (“Report”)

Any user may report a review (including its photos), a public profile, a business, and a conversation or an individual message — with the “Report” buttons in the apps and on the website, or by e-mail to support@kude.bg. A report states the reason (for example spam, offensive content, harassment, false information, other people’s personal data) and optionally a description. The Kude.bg team reviews reports as soon as possible, usually within 24 hours, and confirms to the reporter that the report was received. The person reported is not told who filed the report.

5.12. Blocking

• A user may block another user (a review author or profile) — the blocked user’s reviews are no longer shown to them.
• A customer may block a conversation with a business, and a business may block a conversation with a customer. No new messages can be sent in a blocked conversation, and a business that has blocked a customer does not accept new messages from them.
• The person who blocked may undo the block at any time. The blocked person is not notified.

5.13. Action on reports

Where it finds a breach, the Company may remove or hide the content, refuse to publish it, warn the user, and restrict, suspend or close the account under section 13. A user whose content was removed may ask for a review at support@kude.bg. The Company may report content that constitutes a criminal offence to the competent authorities.

6. Information about businesses and services

6.1.

Information about businesses and services on Kude.bg may be provided by the businesses themselves, by users, partners or other sources.

6.2.

The Company makes reasonable efforts to keep information up to date but does not guarantee that all information is always complete, accurate or current.

6.3.

Opening hours, prices, availability of services, addresses, phone numbers, visiting conditions and other details may be changed by the business concerned.

6.4.

Users can report an inaccuracy with “Report” on the business page or at contact@kude.bg.

7. Relations with third parties

7.1.

Kude.bg may contain information about services and offers of independent third parties.

7.2.

When the User uses a third party’s service — including when booking with or writing to a business — the relationship concerning that service is between the User and the business.

7.3.

The Company is not a party to contracts between the User and independent providers unless expressly stated otherwise.

7.4.

Where the platform links to an external website or service (for example directions in Google Maps or Waze), use of that external website is subject to its own terms and policies.

8. Intellectual property

8.1.

All rights in the design, structure, software, logo, graphics, texts and other elements of Kude.bg to which the Company holds rights are protected by applicable law.

8.2.

Copying, reproducing, distributing, modifying or using protected elements of the platform for commercial or other purposes without prior written permission is not allowed, except where permitted by law.

8.3.

Rights in content provided by third parties belong to their respective authors or right holders.

9. Limitation of liability

9.1.

The Company makes reasonable efforts to keep the platform working normally but does not guarantee uninterrupted access to Kude.bg.

9.2.

Temporary interruptions may occur due to maintenance, updates, technical problems, actions of internet service providers or other circumstances beyond the Company’s control.

9.3.

The Company is not liable for damage caused by:

• acts or omissions of third parties;
• false information provided by users or businesses;
• inability to use external services;
• technical problems beyond the Company’s control;
• unlawful use of the platform by the User.

9.4.

Nothing in these Terms limits the Company’s liability where such a limitation is not permitted by applicable law.

10. Personal data

10.1.

Using Kude.bg involves processing Users’ personal data.

10.2.

Personal data is processed in accordance with applicable law and the Privacy Policy, which forms an integral part of these Terms.

10.3.

The User should read the Privacy Policy before using features that require personal data. Published reviews, photos and public profiles are visible to everyone; messages and bookings become available to the business they are sent to.

10.4. Data of a business’s customers

A business that receives bookings and messages or keeps a customer list on Kude.bg is the controller of its customers’ data and is responsible for using it lawfully, including having consent for marketing messages. The Company processes that data on the business’s behalf and only to provide the service.

11. Cookies

The Kude.bg website uses cookies and similar technologies to operate the site, remember settings and — only with express consent — for usage analysis and marketing. Details and how to manage your choice are in the Privacy Policy and under “Cookie settings” at the bottom of the site. The apps use no tracking technologies.

12. Changes to the platform and the Terms

12.1.

The Company may change these Terms following changes to the platform, its features, the law or other circumstances.

12.2.

The current version of the Terms is published on kude.bg and is available from the apps.

12.3.

The Company notifies account holders of material changes by e-mail or in the apps.

13. Termination of access

The Company may temporarily or permanently restrict a User’s access to the platform in the event of:

• a breach of these Terms, including publishing content under clause 5.4 or harassing other users;
• a breach of applicable law;
• abuse of the platform’s features, including the reporting feature;
• actions that threaten the security or normal operation of the platform.

13.1.

A restriction may consist of removing or hiding content, hiding the public profile, suspending the account (temporarily or until the breach is remedied) or closing the account. The measure is proportionate to the seriousness and recurrence of the breach.

13.2.

The User may ask for information about a measure and its reason, and challenge it, at support@kude.bg.

13.3.

The User may stop using the platform at any time by deleting their account (clause 3.7).

15. Governing law

15.1.

Matters not covered by these Terms are governed by the laws of the Republic of Bulgaria.

15.2.

Disputes arising from the use of Kude.bg are settled by mutual agreement or, failing that, by the competent Bulgarian court under applicable law.

16. Final provisions

16.1.

These Terms are the rules for using Kude.bg.

16.2.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain valid.

16.3.

The first version of these Terms took effect on 25 August 2026. This version takes effect on the date of its publication, shown at the top as “Last updated”.
